Terms conditions for the online sale of products and services between Grupo Joisa S.L and users (“General Conditions”)

1. General conditions prior to contracting

1. a) These General Conditions will expressly regulate the commercial relations arising between Grupo Joisa S.L and Private Users (as this term is defined in the Legal Notice) that, through the website www.grupojoisa .com, purchase the products and services that it offers at all times to Private Users specifically for online sale.
2. b) These General Conditions have been prepared in accordance with the provisions of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 3/ 2014 of March 27, which modifies the Consolidated Text of the General Law for the defense of consumers and users and other complementary laws, and Law 7/1996, of January 15, on Retail Trade Regulation.</ li>
3. c) Grupo Joisa S.L may unilaterally modify, at any time it deems appropriate, the configuration and content of these General Conditions. Notwithstanding this, the General Conditions applicable to a certain transaction will be those in force at the time of its formalization.
4. d) The terms and conditions applicable to the purchase of the Products offered for sale to the public by Grupo Joisa S.L through its Website www.grupojoisa.com will be all those that They are described in these General Conditions and will be detailed on the Website throughout the online purchase process. Through the use of the Website, users declare that they know and accept the different procedures necessary to access the different Products offered on the Website as well as formalize their purchase.

1. b) In accordance with the foregoing, the resale of the Products purchased through the Website is totally prohibited.

4. Products and services offered

1. a) Joisa Group, S.L. will publish, together with the image of each of the Products that are sold through the Website, the specific characteristics of each of them and the applicable sale price.
2. b) Joisa Group, S.L. guarantees that the price of the Products will be the one in force on the day of the formalization of the purchase regardless of the day on which the delivery of the order is formalized.
3. c) If there are applicable offers on the price of the Products, these will be indicated next to the initial price with a different font that allows the Customer to clearly identify the final price of the Product. In any case, the temporary period of validity of the offer will be indicated in its absence.
4. d) Joisa Group, S.L. may, unilaterally and at any time, offer new Products and Services that are sold on the Website as well as suspend or cancel, temporarily or indefinitely, any of the products and services that are available on the Website. .
5. e) The prices established on the Website include the applicable VAT on each product or service as well as any other applicable tax. Grupo Joisa, S.L undertakes to keep prices updated in accordance with the applicable tax at all times.

5. Purchasing system

1. a) The Client must select the chosen product that he wishes to purchase and the quantity thereof. This operation must be viewed in “cart or checkout” and fill in the requested information. The purchase procedure will be in Spanish and English.

The User must fill in and/or verify the information that is requested at each step in order to carry out their purchase. Subsequently, the User will receive an email confirming that their order or purchase request has been received, which will be considered as confirmation of the order placed. The User acknowledges at the time of purchase that he is aware of and accepts the particular conditions of the product in question.

1. b) If desired, the Client may create a User session so that his information is remembered in the next purchase.

6. Billing and payment method

1. a) The Client may request the purchase invoice both in digital format and may request, if desired, the sending of the corresponding invoice in paper format at no additional charge . It will be sent to the email address duly indicated by the Client.
2. b) In accordance with Royal Decree 1619/2012 of November 30, which approves the regulation governing billing obligations, the deadline for the issuance of invoices by Grupo Joisa S.L will be the 15th of the month following the month in which the purchase was made by the Customer.
3. c) Payment for orders can be made through the Caixabank payment systems.

7. Delivery, shipping and expenses

1. a) The Products of Grupo Joisa S.L are delivered to the Clients’ addresses, managing the shipments through the contracted transport companies.
2. b) Delivery times: The purchase will be delivered from Monday to Friday, except holidays, within a period of 24/72 hours from the date of shipment.
3. c) Delivery areas: shipments are available for the entire territory of Spain, for areas outside of Spain that do not have a shipping area you can directly contact Grupo Joisa S.L by email info@grupojoisa.com.
4. d) Transportation costs: Home delivery costs per order will be included in the final price of each Product published on the Website and indicated in the purchase summary email you will receive the Client.

Peninsula: Shipping costs are subject to a flat rate of €4.95. Shipping is free for orders over €7 (only on the peninsula). For orders sent to the Balearic Islands, the Canary Islands, Ceuta and Melilla, the shipping cost will be €12.95.

8. Right of withdrawal of orders

In the products offered on this website, the User has a period of 14 calendar days to withdraw from the contract made, proceeding to the refund of the amounts collected as appropriate for this purpose. The refund to the customer will be through the same payment method used by the customer at the time of making the initial purchase transaction. The period of 14 days will count from the receipt of the Product at the address selected by the buyer. 9. Return Policy

In the event that the client receives a defective or erroneous product from Grupo Joisa S.L, they must follow the following steps:

1. a) Contact Grupo Joisa S.L, within a maximum period of 48 hours from receipt of the package, via email info@grupojoisa.com stating the product you wish to return and the reason . In addition, you must send photographs that prove the defect or error. You will be provided with the address where to send the shipment.
2. b) You must return the item in its original condition and packaging, with the appropriate protection so that it does not suffer damage during transport. 3. c) The shipping costs that involve the return of the product for the reason of a defective or erroneous product will be assumed by Grupo Joisa S.L, otherwise, the return cost will be borne by of the client.

13. Perfection of contracts

The validity of contracts entered into electronically is protected by article 23, sections 1 and 3, of Law 34/2002 on Services of the Information Society and Electronic Commerce: «Contracts entered into electronically will have the same validity and will produce all the effects of the Civil and Mercantile Legal System.» The Contract is perfected from the moment the client expresses his agreement with these contracting conditions by pressing the Acceptance and Reading button of said conditions and after having correctly completed the form offered from the web server www.grupojoisa .com or also by depositing or remitting said acceptance by any other electronic or traditional means at the headquarters offices. After said acceptance, the client will receive notification from www. grupojoisa.com automatically sent to the email address provided in the Registration phase. This email will be sent within 24 hours and will show the information related to your registration and the selected contracting modality with the specific conditions that apply to each modality at any time and that are accepted together with these general conditions at the moment of recruitment. However, and in the case of a technical and automatic element, the reception of said email may not take place due to technical reasons beyond the control of www. grupojoisa.com. In these cases, the customer must contact our customer service to make the shipment effective. The client agrees that it will not be necessary to confirm the receipt of the acceptance of the contract when it has been concluded exclusively through the exchange of electronic mail or another type of equivalent electronic communication, as established in article 28.3 b) of Law 34. /2002 of Services of the Information Society and Electronic Commerce, as well as the provisions of RD 1906/1999. The parties agree to legally equate the client’s handwritten signature to that made using any type of keys, codes or identifying security elements. Notwithstanding the foregoing, Grupo Joisa S.L may require written confirmation when deemed necessary.

14. Nullity of the clauses.

If any provision of this contract becomes illegal, invalid or unenforceable for any reason, said illegality, inapplicability or lack of validity will be limited exclusively to that provision.position and shall not affect the validity or enforceability of the other provisions.

15. Applicable legislation and jurisdiction.

Conflicts that may arise from the application of these rules will be governed by the laws of Spain and, to the maximum extent permitted by law, will be submitted to the Courts of Valencia (Valencian Community).
